Participation Terms and Conditions
- The organiser of this photograph competition is Lohmann & Rauscher GmbH & Co. KG, Irlicher Straße 55, 56567 Neuwied, Germany.
- Participation in the photograph competition for the employees or teams is voluntary.
If an employee does take part in the photograph competition, they declare their acceptance of the aforementioned Competition Rules and these Participation Terms and Conditions by clicking on the corresponding button on the L&R online platform.
The deadline for participation is 30 November 2021. Photographs uploaded after this date will not be entered into the prize draw.
- Any infraction of the aforementioned Competition Rules and/or these Participation Terms and Conditions shall entitle L&R to disqualify the relevant employee from participation. This shall particularly apply in cases where an employee provides incorrect information, or the photograph uploaded by the employee violates any applicable laws or rights of third parties, or the photograph otherwise violates general societal norms of common decency. If the disqualified employee is one that has already been selected for the award of a prize, the prize conferral can be retroactively revoked, and if necessary, the employee may be asked to return the prize.
- L&R reserves the right to terminate the photograph competition at any time, with no requirement to give prior notice nor to comply with any deadlines, either in full or in part, or may otherwise alter the timeline/development of the competition if proper implementation of the competition cannot be ensured due to technical issues (e.g. computer viruses, software/hardware manipulations and/or errors) or legal issues (e.g. prohibition order from a court or other authority). In this case, participating employees shall have no right to assert claims of any type against L&R.
- Prizes are not transferrable, and cannot be exchanged; equivalent-value cash prizes will not be paid out. Should circumstances arise which are beyond the control of L&R, the winner shall accept a reasonable replacement prize.
- By uploading, the participating employee declares that they have exclusive image rights. They declare that all of the persons visible in the photograph are employees in their team, within the L&R Group and agree to the publication of the photograph, being aware of these Competition Rules and Participation Terms and Conditions. Should third parties, contrary to this, assert rights to the image or the infringement of their own rights, such as personality rights, against L&R, the participating employee shall indemnify L&R of all claims as well as the necessary associated expenses, including reasonable legal costs.
By uploading the photograph, the employee declares they will at the same time be granting to L&R the rights to ordinary, non-remunerated, general use (in accordance with these Competition Rules or Participation Terms and Conditions), which will be irrevocable and unlimited with respect to time or place. The use shall be in relation to L&R reporting on the photograph competition, in particular the publication of the photograph as described above, and any editing of the photograph for that purpose.
In the case of a winning employee, L&R shall publish the name of the participating employee, including a link to their uploaded photograph, in the L&R Group’s internal communications media (for example, L&R Inside, L&R Portal, L&R Strategy DIG).
- Privacy policy:
Insofar as L&R processes personal data of the participating employees or the team members visible in the photograph as part of this photograph competition, L&R shall be considered the controller within the meaning of data protection law.
L&R shall process any personal data relating to participating employees or employees belonging to a team obtained during this competition only within the scope of the statutory provisions of data protection law and only to the extent necessary for the execution of the competition or consent has been given by the participating employee or employee belonging to a team; the above paragraph f) applies accordingly.
L&R guarantees the participating employee or employee belonging to a team that their photograph and personal data shall not be passed on to third parties external to L&R without their express prior consent. L&R cannot guarantee, however, that other employees, who access the L&R Group’s internal communications media, will not forward the photograph or personal data to third parties external to L&R from their side.
The following personal data of the participating employee must be provided to participate in the competition: a. first name; b. surname; c. department; d. division; e. country; f. email address.
The participating employee may revoke their consent to having their data processed in accordance with this section g), at any time, and is not required to provide a justification for doing so. If the employee revokes their consent to the processing of their data, they shall not be disadvantaged in any way other than their discontinuation of participation in the photograph competition, and loss of eligibility to win a prize as described above. If the employee revokes their consent following their photograph being uploaded to the online platform, but before it is published on the L&R Group’s internal communications media, then L&R will immediately delete the photograph from its online platform, and the file will no longer be used or edited. If the employee revokes their consent following the aforementioned publication of the video on the L&R Group’s internal communications channels, then the publication carried out via the internal communications media cannot be reversed; the photograph will, however, be removed and L&R will no longer continue to use or edit it.
If an employee belonging to a team is shown in a photograph, they may also revoke their consent; however, in this case, where applicable the photograph shall not be removed, rather the identity of the employee concerned will merely be concealed in the photograph.

The participating employee or employee belonging to a team may assert the rights to which they are entitled within the scope of the statutory provisions of data protection law. In particular, they may [i] request disclosure of their personal data that has been saved and/or [ii] object to the further processing of their personal data and/or [iii] request that their personal data be deleted. All that is required to exercise these rights is, for example, an email to L&R using one of the above email addresses.
Also applicable to L&R Group employees is the Privacy Statement for employment relationships, which has been provided to employees and which is also available in the Intranet. In all other respects, L&R’s Privacy Statement shall apply accordingly. It can be found at www.lohmann-rauscher.com.

Should these Participation Terms and Conditions contain any invalid provisions, the remaining provisions of the text shall remain unaffected and still apply. German law shall apply. Any legal claims asserted in relation to verification of the prize draw or determination of the winner are excluded.
